Sanity: The Trump administration is considering rolling back special protections for transgender students by implementing a rule that properly defines a person’s gender as that which he or she was born with.
A report in The New York Times said that the Department of Health and Human Services may be preparing to establish a legal definition of gender under Title IX which would be premised on a person’s birth gender, according to a memo leaked to the paper.
Title IX is the statute that bars discrimination in primary and secondary education programs that get federal funding.
The memo said that HHS would define a person’s gender as “a biological basis that is clear, grounded in science, objective and administrable.”
That definition could not be legally altered and if there are disputes they would require genetic testing to resolve, the paper reported.
“Sex means a person’s status as male or female based on immutable biological traits identifiable by or before birth,” the memo said, according to the Times. “The sex listed on a person’s birth certificate, as originally issued, shall constitute definitive proof of a person’s sex unless rebutted by reliable genetic evidence.”
The proposed language change would essentially remove what many believe are unfair, unnecessary protections for about 1.4 million Americans who claim they are a different gender, Fox News reported.
“It would also do away with a series of contentions by the Obama administration that people can be any gender they choose,” The Blaze noted.
In practical terms, it would mean that biological boys would have to use the boy’s bathroom and locker rooms, and biological girls would be restricted to their specific facilities.
